Abstract

The aim of the article - based on the analysis of the organizational and legal mechanism and peculiarities of activity, to develop proposals for strengthening the institutional capacity of IDP Councils.

The article analyses the organizational and legal mechanism and peculiarities of the activities of Councils on Internally Displaced Persons in Ukraine in the context of significant forced displacement of the population from temporarily occupied and frontline territories. The problem of protecting the rights and freedoms of internally displaced people (IDP) and involving this category of society in the processes of adopting and implementing administrative decisions at the local, regional, and national levels was examined. The analyses and identifying of systemic challenges that are faced by IDP Councils’ activity as advisory bodies and that limit their efficiency and potential were conducted. The existing drawbacks in the activities of the Councils at the stages from creation to implementation of the results of their activities are identified and systematized. Comparison of the term “institutional capacity” for its relevance to the purposes of the article was made.

It is determined that, first of all, the result of the work of the Councils depends on the regulatory framework, which, among other things, should regulate the mandatory use of developments, as well as the professionalism and motivation of the members of the Councils. Particular attention is paid to the recommendations regarding the possibilities of improving the efficiency of the IDP Councils and involvement of internally displaced persons in the development, adoption and implementation of management decisions at all levels of government in order to improve the policy of protecting the rights and freedoms of internally displaced persons in the context of national efforts to ensure sustainable development and social cohesion. It is argued that the use of the institution of IDP Councils has significant potential, and that is why the introduction of organizational and legal changes in their functioning should ensure the real involvement of IDPs into solving the existing problems of this category of Ukrainian society. It is considered as promising to analyze the use of the IDP Councils' resources for managing the development of territorial communities in the context territorial integrity’s loss, so that the protection of IDPs' rights becomes not a temporary solution, but a stable and integral part of the State policy.
